East West Comfort LLC, Vacation Rental Agreement (EWCVRA) 
Terms and Conditions 
PLEASE REVIEW THE FOLLOWING INFORMATION CAREFULLY!  
Bookings are subject to the following terms and conditions as agreed to at the time of booking. 
A contract between you and the owners will come into existence when we receive payment and accept your booking by issuing a confirmation of booking for the holiday dates you book. The contract binds you & all the members of your party. It is your responsibility to ensure that all members of your party accept the terms of the contract set out in these terms & conditions of booking. Additional policies may be posted at the Property. Failure to disclose all relevant information or comply with these terms may lead to termination of the contract & loss of the booking. 
Terms of Booking & Booking Deposit By placing a booking with us (East West Comfort LLC) you (the lead guest) and your booking party (guests) agree to the following terms and conditions as set-out. During your stay, you agree to abide by the subsequent conditions as set-out. If you have any questions about booking with us, please contact us before making a booking. To place a booking with us the lead guest must be at least 16 years of age. The maximum number of staying guests per room is illustrated in the room occupancy details on the website. Where the person making the booking is different to the lead guest taking up the occupation, the person making the booking may be held responsible for cancellation, non-arrival, and damages as set-out within. To secure any booking we require a full amount of booking to be paid in advance during 24 hours after reservation has been made.
Deposit payments must be 'cleared funds' before a booking can be confirmed. Deposits are only refundable under the conditions set-out here within.  Payments will be collected by our financial department online / over the phone. Any charges raised against us by our banks for handling dishonored bank transfers or any other payments must be reimbursed by the lead guest within seven (7) days of any request to do so. All guests agree to respect the privacy and peace of all other staying guests and neighbors. We reserve the right to cancel a booking with immediate effect if guests are not honoring this agreement or causing a disturbance/nuisance to other guests or neighbors. We (EWC LLC) reserve the right to refuse a booking without giving any reason.  Check-in & Check-out Guests must check-in and check-out by the times stated below;

• Check-in by: 15:00 pm and before midnight on the day of arrival
• Check-out by: 11:00 am on the day of departure

Early check-in and late check-out are available by request only. If guests fail to observe regulations of check in and check out time additional fees described within for the following terms and conditions will be collected.  
Cancellation, Returned Deposit & Non-Arrival Conditions Guest have right to cancel reservation according to the Policies of Cancelation provided by a company what Guest chooses as a main source of booking.  Non-arrival guests, who are unable to attend or fail to attend for whatever reason forfeit their deposit paid and the full amount of the booking will be due. In the rare event we need to cancel your booking with us, please be aware that we cannot be held liable for circumstances beyond our control and that our liability to you is limited to the refund of any payment already made. Notification will be given of the cancellation as soon as possible. 
Damages & Lost Property Guests will be charged a damage deposit of USD 150 upon arrival, which will be refunded on a day of check out.  We reserve the right to keep a damage deposit or charge the lead guest for any damages caused by the course of a booking by any member of the booking party. This includes breakages, spillages, stains, damage to furniture or fixtures and fittings. Any accidental damages should be reported as soon as possible in order to minimize damage and associated costs. Lost keys / fobs / access cards will incur a replacement charge per key / fob / card lost. Any lost property, if discovered and found, left behind by guests during a stay will be held for a period of 1 month. While we will make our best efforts to reunite lost property with their owners we accept no responsibility for replacing lost items and encourage guests to ensure they have all their belonging before checking-out. We may offer to post lost items via recorded delivery at the cost of the property owner, otherwise, the collection can be arranged. EWC LLC is not liable for any temporary defect or malfunction of any equipment, machinery or appliance in the building, grounds or pool. 


Smoking of any tobacco products including, but not limited to cigarettes, pipes, cigars, snuff or chewing tobacco, is only allowed in designated areas or outside of the apartment. Pets We do not accept pets throughout the accommodation, except for service dogs with the existence of a physical and original document.  Parking Where secured garage parking is provided guests accept that they park their vehicles at their own risk. FEES Guests understand and agree to the following fees and charges: 

• Nonrefundable cleaning fee (included in a price) - $85.00 plus tax;
• Late not requested check-out fee - $40.00 per hour;
• Not requested early check-in outside of existing policies - $30  
• Lost keys / fobs / access cards fee - $150.00 per key / fob / card lost.
• Pet Fee - $100.00 per pet. 

We reserve the right to make reasonable amendments or additions to these terms and conditions without notice. 



ACCIDENT WAIVER AND RELEASE OF LIABILITY FROM DAMAGES OF PERSONAL BELONGINGS WHILE STAYING AT EAST WEST COMFORT LLC FACILITIES.   All customers staying with East West Comfort,  I, HEREBY ASSUME ALL OF THE RISKS OF STAYING AND/OR VOLUNTEERING IN ANY ACTIVITY OR EVENT, including by way of example and not limitation, any risks that may arise from negligence OR INCIDENTAL ACCIDENT OF ANY KIND DURING MY STAY AT THE RESORT. or carelessness on MY PART OR MY FAMILY OR persons or entities being released, from dangerous or defective equipment or DAMAGE OCCURRED IN MY LUGGAGE OR LUGGAGE CONTENT INCLUDING PERSONAL BELONGINGS INSIDE THE LUGGAGE OR PERSONAL INJURIES property owned, maintained, or controlled by EWC, or because of their possible liability without fault. I understand that at this event or related activities outside of the apartment arranged by property management, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by event holders, producers, sponsors, organizers, and assigns. The accident AND DOMES waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. This Agreement waives the liability of EWC LLC, hereinafter referred to as use of the services, facilities, and swimming pool. A non-parent cannot legally sign this waiver for other people’s children. It must be signed by a parent/legal guardian. PLEASE READ CAREFULLY AND SIGN BELOW - CHILDREN OF ALL AGE ARE STRICTLY PROHIBITED WITHOUT THERE PARENTS SUPERVISION IN OR AROUND THE POOL I, (GUEST OF EWC), utilizing the services, facilities, swimming pool. I hereby agree that the use of the services, facilities, swimming pool, is at my child’s and my own risk. As a condition of me and my child’s use of such services, facilities, swimming pool. I on behalf of myself, my heirs and assigns and my child expressly agree to forever discharge, waive and release EWC, its owners, management, staff, servants, agents, employees and/or independent contractors and their heirs, successors and assigns from any and all claims, demands, injuries, damages, actions, or courses of action, and from all acts of active or passive negligence on the part of EWC, its owners, management, staff, servants, agents, employees and/or independent contractors that I or my child (if applicable) may have or acquire against EWC, its owners, management, staff, servants, agents, employees and/or independent contractors on account of bodily injury, mental injury and/or property damage from, any mishap, accident, loss, damage or injury suffered by my child or myself or others resulting from , connected with or caused by the use of EWC services, fitness programs, swimming pool and /or facilities whether located on or off the EWC apartments premises, including, but not limited to any injury resulting from mechanical defects or failure of any equipment or devices used in such services, programs, swimming pool or facilities. I further agree to defend, indemnify and hold harmless EWC, its owners, management, staff, servants, agents, employees and/or independent contractors, their heirs, successors and assigns from any and all claims, losses or liability arising from, connected with or caused by me or my child’s use of EWC services, swimming pool and facilities, whether located on or off the apartments premises. I declare and affirm that I and my child am (or are) in good medical and physical condition and that the use of the EWC services, facilities, swimming pool and does not pose any danger to me or my child’s (if applicable) health. I agree that I and my child will abide by all the rules and regulations of the INN, which may be posted at the INN, or issued orally and/or published. These rules may be amended at the RESORT discretion. I agree that I and my child will not engage in behavior injurious to the enjoyment of the RESORT by other Members or Guests. I understand and agree that my and my child’s use of EWC apartment may be immediately terminated if my (or their) behavior is not in accordance with the above. I, CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. AM AWARE THAT THIS IS A RELEASE OF LIABILITY AGAINST EWC AND I AGREE OF MY OWN FREE WILL TO THOSE CONDITIONS.   
By my signature, I acknowledge that I have read and agree to abide by the conditions set forth in this Rental Agreement and all policies, regulations, and rules set forth by EWC LLC. I further understand and agree that to breach any items contained within the above-referenced documents will result in my eviction without refund. I understand that EWC LLC has made every effort to provide accurate information, however, in the event of errors, omissions, any changes by EWC LLC I agree not to hold EWC LLC responsible or liable.
